This sales strength comes amidst a proliferation of topical CBD products of questionable value being offered by a number by national retailing chain stores across the country. As national chain stores seek to get a piece of the exploding CBD market, most appear to be doing so on a limited basis by offering only topical CBD lotions and creams instead of the more popular ingestible CBD products. The legality of CBD is confused and murky at both the state and federal level. This is likely why big national chain stores are cautiously approaching the CBD market by offering only topicals and creams. Tetrahydrocannabinol (THC), the best-known compound in marijuana, is the substance that produces the marijuana high. But CBD does not produce any such psychoactive effect.

According to industry observers, CBD made from hemp must contain less than 0.3% THC, the psychoactive ingredient in cannabis, in order to be legal. But there are differences of opinion as to what is and what isn't legal in the murky, confused arena of CBD. However, CBD products made from cannabis with levels of THC in excess of 0.3% are certainly illegal except in those states that have legalized marijuana.
